# What happens if you miss your court date on a ticket in El Paso

A traffic ticket is a criminal case. A small one, usually a fine only Class C misdemeanor, but a criminal case with a court setting on it. When you miss that setting, the case does not close out and quietly disappear. It gets worse on a schedule, and nobody calls to tell you.

The good news is that this is one of the most fixable problems in the courthouse. The bad news is that it stops being cheap to fix the moment somebody else discovers it for you, usually at a traffic stop or a license renewal counter.

## What happens when you miss a court date on a ticket

Three things can follow a missed setting, and they can all follow the same one.

- The court can issue a warrant for your arrest on the original citation.
- You can be charged separately for failing to appear, which is its own offense, on top of whatever the ticket was for.
- The failure can be reported so that your driver's license renewal is denied until the case is resolved.

That last one is the reason people find out years later. The ticket sits quietly until the day the license needs renewing, and then it is suddenly the only thing standing between you and being able to drive legally.

What does not happen is the case going away on its own. There is no point at which the court stops caring.

## First, find out which court has your ticket

This is the step people skip, and it is the one that wastes the most time. City of El Paso ordinance citations and many fine only Class C offenses go to the El Paso Municipal Court. A citation written by a sheriff's deputy, a constable or a state trooper outside municipal jurisdiction may instead go to an El Paso County Justice of the Peace court.

The citation controls where you answer, not where you live. People show up at the wrong counter, are told there is nothing under their name, go home relieved, and get arrested six months later on a warrant that was sitting in a different court the whole time.

Two other possibilities are worth checking in this region. Hudspeth County is a separate county with its own courts and its own filing offices. And a citation written on the New Mexico side, in Anthony, Sunland Park, Santa Teresa or Las Cruces, is a New Mexico matter in Doña Ana County, which is in New Mexico's Third Judicial District, with its own courts and its own procedure.

Look at the citation itself. The issuing agency and the court are printed on it, and that is the most reliable answer you have.

## How to fix a missed court date on a ticket

Courts deal with missed settings constantly and there is a routine for it. In most cases the court can reset the case for a new date, and where a warrant has already issued, it can be lifted by posting the appropriate bond so the case can go back on the docket.

The order matters. Handle it before a traffic stop rather than during one. A resolved reset is an administrative errand. The same problem discovered at midnight on the side of Interstate 10 is a night in custody.

Be careful what you say while you are handling it. Calls to a court are commonly recorded, and a clerk is not the person who decides your case. Give them the citation number and ask what the court needs. Do not argue the facts of the stop at the window.

## What happens if you are arrested on the warrant

Texas generally requires that an arrested person be brought before a magistrate without unnecessary delay and no later than 48 hours after the arrest. At that appearance you are told what you are accused of, advised of your rights, and conditions of release are addressed. It is not a hearing on whether you did it.

Texas also has release rules that turn on whether the State is ready to proceed. They run broadly 90 days for a felony, 30 days for a Class A misdemeanor, 15 days for a Class B and five days for a Class C, each with statutory conditions and exceptions. They are not automatic and they are not a path to dismissal. They are one of the things a lawyer watches while somebody is held.

## The hold on your driver's license

When a failure to appear is reported, a renewal can be refused until the underlying case is taken care of. The hold is not lifted by paying something at the license office. It comes off after the court that reported it is satisfied, which means the fix starts at the court, not at the counter where you were turned away.

If you have more than one old ticket, expect more than one hold. They are reported separately by the courts that issued them, so clearing one does not clear the others. Ask each court for its own status rather than assuming the list is finished.

## Your options once the case is back in front of the court

Once the case is active again, the ticket itself is still unresolved, and you have choices about it. Paying it is only one of them, and it is not automatically the cheapest one.

- Plead not guilty and request a trial, which is your right on a fine only Class C misdemeanor.
- Ask about a driving safety course, where the offense and your record qualify.
- Ask about deferred disposition, where the court sets conditions for a period of time and the outcome depends on completing them.
- Plead and pay, which resolves it immediately and is a conviction.

Eligibility for the middle two depends on the offense, your driving history and the court, and no one can tell you the answer before the court looks at your case. What can be said is that paying a ticket by mail is a plea. It closes the case as a conviction, it can be reported, and there is no version of the story where you get to reconsider afterward.

## What this leaves on your record

A conviction on a traffic citation stays visible, and a failure to appear charge does not look like a paperwork mistake to somebody reading a background check later. That is worth knowing before you decide the fastest resolution is the best one.

Record relief in Texas is narrower than most people assume. Expunction is available only in defined situations, including some acquittals, pardons, qualifying dismissals, and arrests that were never charged once the applicable waiting period has passed. An order of nondisclosure seals eligible records from much public access, though not from every government user. Neither is automatic, and how a case closes now is what decides whether either is available later.
